Abstract

The rapid development of transportation in Indonesia has given rise to a worrying phenomenon, namely the large number of children, especially at the Junior High School (SMP) level, who use their own motorbikes. This clearly violates the regulations of Law Number 22 of 2009 concerning traffic and road transportation. Objective: This study aims to directly observe the use of motorbikes, the level of legal awareness of students regarding traffic regulations, and how the implementation of these regulations is applied at SMPN 1 Temayang. Method: This study uses a qualitative phenomenological method with data collection through in-depth interviews, observation and documentation with the school, students, parents and the police. Results: The discussion of the findings in this study is divided into three, the first is more than 200 students bring their own motorbikes to school because the distance from home is very far, the lack of public transportation, following friends, and the busyness of parents working. Secondly, students actually already know the minimum age to ride a motorbike is 17 years old or already have a driver's license, but this knowledge is not implemented because it has become a habit of the surrounding community. The three parties, the school and the police, are faced with a dilemma, where they refrain from giving firm sanctions in the form of fines or written regulations, and prefer an educational approach because they are worried that children who live far from school will have difficulty with transportation and will drop out of school.
